The Labour Inspectorate is the supervisory authority for compliance with labour law regulations and occupational health and safety regulations. It carries out inspections both according to plan and on the basis of complaints, and a complaint can also be filed anonymously by a former employee. The most frequently identified deficiencies are missing or subsequently completed working time records, illegal employment including work without a concluded contract, non-compliance with the conditions of agreements, missing safety training and incorrectly concluded non-competition clauses. When employees are posted abroad, it also checks compliance with notification obligations. It is worthwhile for companies to keep documentation up to date on an ongoing basis, because it must be presented immediately during an inspection and subsequent adjustments are usually recognisable. The authority regularly publishes a list of the most common findings, which serves as a practical checklist. The option of advice before an inspection, which the inspectorates provide free of charge, is also useful.
